1.Introduction to Our Intellectual Property Commitments and Scope
1.1 This Intellectual Property and Copyright Policy (hereinafter referred to as the “IP & Copyright Policy” or “Policy”) sets forth in exhaustive detail the principles, practices, procedures, protections, and compliance mechanisms adopted by BuoyantWave Learning Technologies LLP, operating under the brand name Bodhaka BrightChalk (collectively referred to as “we,” “us,” “our,” or the “Company”), concerning all matters related to intellectual property rights, copyrights, trademarks, trade secrets, patents (where applicable), moral rights, and associated licensing arrangements on our Digital Platform. This Policy applies comprehensively to all content, features, outputs, and interactions on the Platform, including but not limited to the websites (https://bodhaka.org and https://learning.bodhaka.org/brightchalk), mobile or web applications, AI-powered learning modules (Ask Bodhaka, Equation Solver, Guided Discovery), Project Guide, User-Uploaded Images, dynamically fetched educational imagery from open sources, proprietary curriculum knowledge base, AI-generated explanations, and any associated educational services.
1.2 Our commitment to upholding the highest standards of intellectual property respect, both for our own original creations and for the rights of third parties, including creators of Creative Commons works and educational content providers is paramount and unwavering. This commitment is grounded in strict adherence to the Copyright Act, 1957 (particularly Section 52 on fair dealing for educational, research, and transformative purposes), the Information Technology Act, 2000 and its Rules 2021 (“IT Act”), the Trade Marks Act, 1999, the Designs Act, 2000, and all other applicable Indian laws, regulations, judicial precedents, and international best practices. We recognize that the Platform serves minors in Classes 6 to 12 and therefore integrate intellectual property compliance with child safety, data protection, and educational integrity.
1.3 By accessing, registering on, or using the Platform in any manner, uploading images or content, interacting with AI tutors, fetching or viewing educational imagery, or availing any services, you (including the Parent on behalf of the Student) expressly acknowledge that you have read, fully understood, and unconditionally agree to be bound by this Policy in its entirety. This Policy forms an integral and inseparable part of our Terms of Service, Privacy Policy, and Educational Disclaimer. In the event of any conflict between this Policy and other governing documents, this IP & Copyright Policy shall prevail on all matters relating to intellectual property, copyright, content ownership, licensing, and infringement handling.
1.4 If you do not agree with any provision of this Policy, you must immediately cease all use of the Platform and discontinue any ongoing interactions. Continued access or use after such disagreement constitutes your binding acceptance of this Policy.
1.5 We reserve the absolute right to amend, revise, update, or supplement this Policy at any time to reflect evolving operational practices (such as enhancements to our RAG pipeline or safety filters), changes in law (including interpretations of Section 52 of the Copyright Act), technological developments, or business requirements. Any such modifications shall become effective immediately upon posting on the Platform with an updated “Last Updated” date. You are solely responsible for reviewing this Policy periodically. Your continued use of the Platform following any updates signifies your acceptance of the revised terms.
1.6 All capitalized terms used in this Policy but not defined herein shall carry the meanings assigned to them in the Terms of Service or Privacy Policy.
2.Ownership and Protection of Company Intellectual Property
2.1 The Platform, including its underlying software architecture, AI models and algorithms, user interfaces, design elements, logos, trademarks, service marks, trade dress, proprietary curriculum content, internal knowledge base, training methodologies, and all original text, graphics, and multimedia created by or exclusively licensed to the Company, are the sole and exclusive intellectual property of BuoyantWave Learning Technologies LLP. All rights, title, and interest therein are protected under applicable Indian and international intellectual property laws.
2.2 Our proprietary curriculum content consists entirely of original educational materials explanations, worked examples, notes, problem sets, Socratic prompts, and structured learning pathways authored in-house by our team or by qualified external educators under strict assignment and confidentiality agreements. This content is mapped to the syllabus solely for topical alignment, sequencing, and grade-level appropriateness.
2.3 No user, parent, student, or third party acquires any ownership, copyright, or other proprietary rights in the Platform or any part thereof merely by using it. Any unauthorized copying, reproduction, modification, distribution, public display, performance, or creation of derivative works is strictly prohibited and may result in immediate account suspension, termination, and legal action.
2.4 The Company grants users a limited, revocable, non-exclusive, non-transferable, non-sublicensable, personal license solely for non-commercial educational purposes during the active validity period of their subscription or purchased credits. This license is automatically revoked upon termination of access or violation of any terms.
3.Use of Creative Commons, Public Domain, and Third-Party Educational Imagery
3.1 To enrich visual understanding in AI-generated responses (particularly within Ask Bodhaka), the Company may dynamically fetch and display educational imagery exclusively from Creative Commons-licensed or public-domain sources, primarily available through Wikipedia and equivalent open repositories. We never use copyrighted, paid, or commercially licensed imagery without proper authorization.
3.2 Every fetched image is subjected to our mandatory 2-Level AI Safety Filter (two independent AI layers that must both clear the image for display; otherwise, it is dropped and a text-only response is provided). This process ensures educational appropriateness while maintaining compliance with child safety standards.
3.3 The Company makes reasonable best efforts to provide accurate attribution to the original creators or licensors in accordance with the specific Creative Commons license terms applicable to each image. Attribution, where required, is displayed alongside the image or in accompanying metadata.
3.4 We do not claim any ownership rights over such third-party imagery. All use is strictly in accordance with the relevant open licenses and for legitimate educational purposes benefiting students.
3.5 In the event of any missed attribution or dispute regarding licensing metadata originating from the source platform, the Company provides a protected cure period of 72 hours from receipt of a valid notice to either update the attribution or remove the image. This mechanism is designed to promote good-faith resolution while protecting the Platform’s intermediary status under the IT Act.
4.Syllabus Alignment through Retrieval-Augmented Generation (RAG) – Transformative and Fair Dealing Use
4.1 The Company’s AI systems are aligned with the standard syllabus for Classes 6–12 only in respect of topics covered, recommended sequencing, conceptual depth, and learning outcomes. This alignment is purely descriptive and functional.
4.2 Our internal knowledge base is composed exclusively of original, Company-owned content. NCERT textbooks, chapters, illustrations, exercises, or solutions are never hosted, displayed, mirrored, reproduced, or redistributed on the Platform in any form.
4.3 Where reference to standard material is beneficial, we employ a proprietary Retrieval-Augmented Generation (RAG) pipeline with the following technical steps:
- Ingestion Phase: Relevant portions of in-house created content are broken into small, contextually meaningful “chunks” (typically a few sentences), converted into high-dimensional mathematical embeddings using advanced models, and stored securely in a private, internal vector database that is inaccessible to users.
- Retrieval Phase: When a student submits a query, the system identifies and retrieves only the most semantically relevant chunks as non-displayed reference material.
- Generation Phase: The AI model reviews these reference chunks and generates an entirely fresh, original explanation, tailored specifically to the student’s question and expressed in its own words and pedagogical style, exactly analogous to a qualified human teacher who studies a textbook thoroughly and then explains the concept independently in class without reading from or copying the book.
4.4 This RAG-based approach ensures no reproduction of NCERT’s original literary expression occurs in any user-facing output. It qualifies as transformative educational use and is protected under Section 52 of the Copyright Act, 1957, which permits fair dealing for the purposes of research, private study, criticism, review, and education (including analogies to classroom instruction).
4.5 The Company is not affiliated with, endorsed by, sponsored by, or in any official relationship with the National Council of Educational Research and Training (NCERT) or any government educational authority. The phrase “syllabus aligned” is used descriptively only and does not imply any partnership, approval, or official status.
4.6 We expressly disclaim any liability or responsibility if any user or third party misinterprets our content as official NCERT material.
5.User-Generated Content, Uploaded Images, and License Grant to the Company
5.1 Users may upload images (such as photographs of homework problems or diagrams) only in the three core learning modules, and only after they successfully pass the AI Vision NSFW Pre-Upload Filter.
5.2 By uploading any content or image, you grant the Company a worldwide, royalty-free, non-exclusive, irrevocable, perpetual license to use, process, store (if cleared), analyze, and incorporate such content solely for the purposes of delivering the requested educational service, improving our safety filters, training safety models (on an anonymized basis), and maintaining compliance audit logs.
5.3 You represent, warrant, and covenant that any content you upload is your own work or properly licensed, does not infringe any third-party intellectual property rights, and fully complies with the prohibitions in our Terms of Service (no explicit, violent, harmful, or unsafe material). Rejected images under the NSFW Filter are never stored, processed further, or used in any way.
5.4 The Company does not claim ownership over your uploaded content. However, you acknowledge that once cleared and used in a session, the Company bears no responsibility for any subsequent claims regarding that content.
6.Prohibited Conduct Related to Intellectual Property
6.1 Users are strictly forbidden from engaging in any of the following: copying, reproducing, modifying, adapting, translating, distributing, publicly displaying, or performing any Platform content; scraping, crawling, or data-mining the Platform (including attempts to extract RAG knowledge base content); reverse-engineering, decompiling, or attempting to discover the underlying AI models or algorithms; removing, obscuring, or altering any copyright notices, attributions, or watermarks; using Platform content for any commercial, competitive, or non-educational purpose; or creating adversarial prompts designed to force verbatim reproduction of NCERT or other protected material.
6.2 Any such prohibited activity constitutes a material breach of this Policy and the Terms of Service, triggering immediate suspension or termination and potential legal proceedings.
7.Notice and Takedown Procedure for Copyright and IP Claims
7.1 The Company maintains a robust, formal Notice and Takedown mechanism fully compliant with the intermediary due-diligence requirements under the IT Act and Rules.
7.2 Any person who believes that material on the Platform infringes their copyright or other intellectual property rights may submit a written notification to the Grievance Officer at compliance@bodhaka.org. The notice must include:
- Sufficient identification of the copyrighted work or IP right claimed to be infringed;
- Clear description and location (URL or precise reference) of the allegedly infringing material;
- Contact information of the complainant (name, address, email, phone);
- A good-faith statement that the use is unauthorized and that the information in the notice is accurate;
- A declaration made under penalty of perjury regarding the accuracy of the claim.
7.3 Upon receipt of a complete and valid notice, the Company will act expeditiously to investigate, and where appropriate, remove or disable access to the disputed material. For Creative Commons imagery disputes involving attribution, a 72-hour cure period is afforded to rectify the issue before permanent removal.
7.4 Affected users may submit counter-notices, and the Company will follow the procedures prescribed under applicable law.
8.Grievance Redressal Mechanism
8.1 The Company has designated a Grievance Officer to handle all intellectual property, copyright, and content-related complaints:

8.2 Every grievance will be acknowledged within 24 hours of receipt and resolved substantively within 15 days (or such shorter timeline as mandated by law) in full compliance with the IT Rules 2021.
9.Limitation of Liability and Disclaimers
9.1 The Company operates as an intermediary under Section 79 of the IT Act with respect to dynamically fetched third-party content and RAG reference material. We disclaim all liability for any inadvertent infringement where we have exercised reasonable due diligence through our safety filters, attribution practices, and internal policies.
9.2 To the maximum extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or in connection with any intellectual property matters, including but not limited to claims of copyright infringement, loss of data, or educational outcomes.
10.Indemnification Obligations
10.1 You and the Parent (on behalf of the Student) agree to indemnify, defend, and hold harmless the Company, its partners, officers, employees, agents, and successors from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (i) your breach of this Policy; (ii) any infringement claims connected to content you upload; or (iii) any violation of third-party intellectual property rights through your use of the Platform.
11.Miscellaneous Provisions
11.1 This Policy, together with the other legal documents, constitutes the entire understanding between you and the Company regarding intellectual property matters.
11.2 If any provision is held invalid, the remaining provisions shall continue in full force.
11.3 This Policy is governed exclusively by the laws of India, with exclusive jurisdiction vested in the courts of Bengaluru, Karnataka.
